bappa.org is a 365-day platform relating to Ganeshotsav, Indian heritage and local traditions. kaladhipati.com presents related content through the 64 Classical Arts and the makers who practise them.
2What these Terms cover
These Terms constitute a binding agreement between you and EFLAG and apply to:
- bappa.org and its subdomains, including accounts, contributions, Karma, Yatra, Worship and Heritage;
- kaladhipati.com and its subdomains; and
- WhatsApp and other communication services operated in connection with the platform.
By accessing or using the platform, creating an account, submitting content, participating in Karma or rewards, or using a marketplace feature, you agree to these Terms. If you do not agree, you must not use the relevant feature or platform.
Our Privacy Policy forms part of these Terms. Where a feature has separate terms, such as marketplace, reward, contest, draw or seller terms, those terms also apply to that feature. In the event of a conflict, the feature-specific terms will prevail only for that feature, unless expressly stated otherwise.
3Availability and territorial scope
The platform is operated from India and is principally directed to users in India. We may make selected content or services available outside India, but we do not represent that the platform or any particular feature is available, lawful or suitable in every jurisdiction.
We do not intentionally target or solicit users in jurisdictions where we have expressly stated that the platform is not directed. If you access the platform from outside India, you do so on your own initiative and are responsible for compliance with applicable local law.
Physical rewards and marketplace items are delivered only to destinations that we or the relevant seller expressly support, which may include India, South-East Asia and the Gulf, subject to product-specific delivery restrictions.
Nothing in these Terms excludes or restricts any right that cannot lawfully be excluded or restricted under mandatory law applicable to you.
4Eligibility and age requirements
Public pages may be viewed without an account, subject to these Terms. Unless a feature-specific term states otherwise, you must be at least 18 years old to create an account, submit contributions, participate in Karma, redeem rewards, make marketplace transactions through an account, or use other features that require an account.
We do not knowingly permit persons under 18 to create or hold accounts. If we reasonably determine that an account has been created or operated by a person who is not eligible, we may suspend or close the account and take steps concerning associated personal data in accordance with applicable law and our Privacy Policy.
If you are a parent or guardian and believe that an ineligible person has created an account, please contact the Grievance Officer.
5Accounts and security
- Accounts may be created using an Indian mobile number and a one-time passcode or other authentication method that we make available.
- Your registered mobile number or other approved identifier may be used to identify your account.
- One account may be maintained per permitted identifier unless we expressly allow otherwise.
- You must not create or operate an account for another person without their knowledge and authority.
- You are responsible for activity carried out through your account and for keeping your device, authentication credentials and registered number secure.
- Notify us promptly if you believe your account has been compromised or used without authorisation.
- We may require reasonable verification where a registered mobile number is reassigned, disconnected or otherwise ceases to belong to you.
- We may restrict, suspend or require additional verification where necessary to protect users, the platform, third parties or the integrity of the service.
6User content and licence
6.1 Ownership
Subject to the rights of third parties and the licence granted below, you retain ownership of content that you submit to the platform, including stories, photographs, recipes, traditions, recordings, voice notes, videos and other materials ("User Content").
6.2 Licence to EFLAG
When you submit User Content, you grant EFLAG a worldwide, royalty-free, non-exclusive, transferable to service providers, and sublicensable only to the extent necessary to operate the platform, licence to host, store, reproduce, communicate, publish, display, format, resize, adapt technically, translate, moderate, index, back up and otherwise process the User Content for operating, securing, improving and promoting the platform and its cultural programmes.
The licence includes use on bappa.org, kaladhipati.com, their official social and communication channels, and through service providers engaged by EFLAG, provided that such use remains within the purposes described in these Terms and the Privacy Policy.
EFLAG may create technical derivatives such as thumbnails, compressed versions, translations, captions, tags, metadata or machine-assisted illustrations where reasonably necessary for the operation or presentation of the platform.
6.3 Commercial and sponsor-related use
Unless a feature-specific consent, campaign term or separate agreement expressly provides otherwise, EFLAG will not sell User Content as a standalone asset or grant a third party ownership of User Content merely because it appears on the platform.
EFLAG may, however, acknowledge sponsors, partners and programme supporters in connection with the platform and may display sponsor or partner branding around platform pages, programmes, events or features. Such acknowledgement does not transfer ownership of User Content to a sponsor or partner.
Where EFLAG proposes to use identifiable User Content itself in paid third-party advertising or in a manner that expressly attributes the content as an endorsement of a third party, EFLAG will obtain any additional consent required by applicable law or the relevant campaign terms.
6.4 Attribution
Contributions may be published under your chosen public display name. If no display name is provided, we may publish the contribution without a name. We will not publicly display your registered mobile number merely because you submitted User Content.
6.5 Heritage archive consent
Where a contribution is proposed for inclusion in a formal heritage inventory or archive shared with a government or institutional partner, any additional consent required for that archive use will be obtained separately where applicable. Declining optional archive consent will not, by itself, prevent ordinary publication of a contribution or participation in the platform.
6.6 Withdrawal
You may request removal of a contribution from public view, subject to applicable law and the operational limitations described below.
- If a contribution has already been incorporated into a formal heritage inventory or archival record shared with an institutional or government partner, complete withdrawal from that external record may not be technically or legally possible.
- The platform may retain limited technical, security, audit or transaction records for legitimate purposes and as permitted by law. Where such records are linked to your identity, we may de-identify or sever that linkage where appropriate rather than delete an immutable audit entry.
- Removal from public view does not necessarily require deletion from backups, legal records or other records that must be retained under applicable law or the Privacy Policy.
6.7 Your promises regarding User Content
By submitting User Content, you represent and warrant that, to the best of your knowledge:
- you own the content or have the rights and permissions necessary to submit it and grant the licence in these Terms;
- the content does not infringe copyright, trademark, privacy, publicity or other third-party rights;
- you have obtained any permission reasonably required for identifiable persons appearing in the content, where such permission is legally required;
- you have not knowingly published another person's personal information without lawful authority or consent where consent is required; and
- where the content records a tradition or information obtained from another person or community, you have represented its source and context honestly.
6.8 Indemnity
To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless EFLAG, its affiliates, directors, officers, employees, contractors and representatives against third-party claims, losses, liabilities, damages, costs and reasonable legal expenses arising from or relating to: (a) your breach of these Terms; (b) User Content submitted by you; (c) allegations that your User Content infringes third-party rights; or (d) your unlawful, fraudulent or abusive use of the platform.
This indemnity will not apply to the extent a claim, loss or liability is finally determined to have resulted from EFLAG's wilful misconduct or gross negligence.
7Rules of use
You must not use the platform to publish, transmit, upload or otherwise make available content or conduct that:
- is unlawful under applicable Indian law or is prohibited from being hosted or transmitted under applicable intermediary or other technology laws;
- is obscene, sexually exploitative, child sexual abuse material, invasive of privacy, harassing, threatening, hateful or otherwise prohibited by applicable law;
- promotes enmity between religious or social groups or is reasonably likely to incite violence or outrage religious or communal sentiments;
- impersonates another person or falsely represents an association with a person, organisation or public body;
- knowingly contains materially false information presented as fact, or fabricated or synthetically generated material presented as an authentic record where such presentation is prohibited or misleading;
- infringes intellectual property or other proprietary rights;
- contains malware, viruses or code intended to interfere with the platform or another person's device;
- threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order;
- facilitates fraud, money laundering, unlawful gambling or other unlawful activity;
- scrapes, bulk-downloads, resells or systematically extracts platform content without written permission;
- circumvents rate limits, access controls or security measures;
- uses automated means to create accounts, manipulate Karma, rewards, rankings or engagement, or otherwise interfere with platform integrity; or
- attempts to identify, locate or contact another user using platform data except through features expressly provided for that purpose.
8Moderation, suspension and removal
Submissions may be reviewed before publication. Review may be assisted by automated systems and may also be conducted by human moderators. We may decline, hold, restrict, edit for length or formatting, label, de-publish or remove content that breaches these Terms, applicable law or platform standards.
We may suspend or terminate an account where there is a material or repeated breach, suspected fraud or abuse, security risk, unlawful conduct, manipulation of platform systems, or where suspension or termination is required by law.
Where reasonably practicable, we may tell you why a submission was declined or restricted and may allow you to revise and resubmit it.
EFLAG may rely on applicable intermediary safe-harbour protections to the extent available under law. Nothing in these Terms constitutes a representation that EFLAG will qualify for or retain safe-harbour protection in every circumstance.
We may use automated systems for moderation and content safety, but an automated flag or decision does not by itself establish wrongdoing. Where an appeal or review mechanism is available, a human review may be undertaken in accordance with applicable law and platform procedures.
9Karma, rewards, contests and draws
Karma is a recognition or participation score. It is not money, does not constitute property or a debt owed by EFLAG, and has no cash value unless a specific written programme term expressly states otherwise.
- Karma cannot be bought, sold, transferred between accounts or exchanged for cash.
- We may correct, adjust, suspend or reverse Karma awarded through error, technical fault, fraud, abuse or manipulation.
- Rewards, contests, draws and similar programmes are subject to their own published terms, eligibility requirements, availability and applicable law.
- No purchase or payment is required to participate where the applicable programme terms state that participation is free.
- Eligibility may be restricted by age, residency, location, product availability or applicable law.
- We may require identity, address or other reasonable information to fulfil a reward.
Separate contest or draw terms will prevail over this clause to the extent of any inconsistency concerning that specific programme.
10Store and marketplace
The platform may offer a store or marketplace through which products, craft items, services or other offerings may be displayed or sold.
Where a listing is provided by an independent maker or seller, the maker or seller may remain the seller of record and the contract of sale may be directly between you and that maker or seller. The applicable listing, marketplace terms and checkout flow will identify the relevant seller and payment arrangement.
Where payments are processed through a third-party payment gateway, the payment gateway may process payment information under its own terms and privacy practices. EFLAG does not ordinarily receive or store complete card credentials.
Where EFLAG acts only as an intermediary or payment facilitator, the relevant seller remains responsible for product description, quality, lawful sale, applicable taxes, invoicing, warranties, delivery, returns and refunds, except to the extent expressly undertaken by EFLAG.
Where a seller provides a UPI ID or QR code for direct payment, payment is made to the seller and the seller is responsible for confirming receipt. EFLAG is not a party to that direct payment transaction.
EFLAG may facilitate communications regarding returns, cancellations or refunds, but unless expressly stated otherwise, EFLAG does not determine a seller's contractual liability.
Nothing in this clause limits consumer rights that cannot lawfully be excluded under applicable law.
11WhatsApp, SMS and communications
- Where you use the platform through WhatsApp, we may send service messages necessary to respond to your request or provide the service.
- Optional reminders, nudges and promotional communications will be provided only where permitted by applicable law and the applicable consent or preference mechanism.
- You may stop optional WhatsApp messages by using the available opt-out mechanism, including replying STOP where supported, or through platform settings.
- WhatsApp communications are delivered through Meta's WhatsApp Business Platform and/or relevant messaging partners and are also subject to their terms and policies.
- SMS one-time passcodes may be sent for authentication through applicable registered messaging templates.
- Standard carrier, telecom or messaging charges may apply.
12Third-party content and automated features
Some images, recordings, reference materials and other content may be supplied under third-party licences, including open licences such as those applicable to Wikimedia Commons. Such content remains subject to its applicable licence and attribution requirements.
The platform may embed third-party media players and link to external websites. EFLAG does not control those third parties and is not responsible for their content, availability, security, privacy practices or terms.
The platform may use automated systems to classify submissions, identify spam, suggest tags, translate content, assist moderation, improve quality and generate illustrations where a contribution does not include an image.
Where automated or synthetically generated illustrations are used, EFLAG may label them as generated or assisted content and may conduct human review before publication where appropriate.
Machine translations may contain errors. If there is a conflict between a translation and the English version of these Terms or the Privacy Policy, the English version will govern to the extent permitted by law.
EFLAG may implement technical measures, labelling, metadata or identifiers for synthetically generated or modified information where required by applicable law, including the IT Rules as amended from time to time.
13Heritage, religious, Panchang and travel information
Content concerning rituals, observances, temples, traditions, arts and heritage is provided primarily for cultural and educational purposes. Practices may differ by family, community, region and lineage. The platform does not represent that every description is the only correct religious or cultural practice.
Panchang, tithi, moonrise and related timings are informational. Where a timing is calculated by the platform rather than sourced from a published Panchang, this may be indicated on the relevant screen. Users should verify important religious timings against their preferred local Panchang or tradition.
Travel information, including routes, access, opening arrangements and local conditions, may change and may be incomplete or outdated. Users should verify information locally before travelling. EFLAG is not responsible for travel arrangements, delays, access restrictions, personal safety or third-party travel services.
14Intellectual property
The platform, including its software, design, layout, databases, functionality, trade names, logos, trademarks, bappa.org and Kaladhipati marks, curated editorial material and other materials created or licensed by EFLAG, are owned by EFLAG or its licensors.
Except for the limited right to use the platform in accordance with these Terms, no licence or right is granted to reproduce, modify, distribute, publicly display, sell, reverse engineer or otherwise exploit EFLAG's intellectual property without prior written permission.
If you believe material on the platform infringes your copyright, trademark or other intellectual property rights, you may submit a written complaint to the Grievance Officer identifying the relevant right, work, content or URL, basis of the claim and information reasonably required to contact you. We may request supporting documents and may restrict, remove or disable access to the material while the complaint is reviewed, subject to applicable law.
15Disclaimers and limitation of liability
The platform is provided on an "as is" and "as available" basis to the fullest extent permitted by law. EFLAG does not warrant that the platform will always be uninterrupted, secure, error-free, current or complete, or that all content will be accurate.
To the fullest extent permitted by applicable law, EFLAG will not be liable for indirect, incidental, special, exemplary or consequential loss, loss of profits, loss of business opportunity, loss of goodwill, loss of data or similar losses arising from or relating to your use of the platform.
EFLAG is not responsible for acts or omissions of independent sellers, makers, payment gateways, telecommunications providers, social-media or messaging platforms, external websites, travel operators or other third parties, except to the extent liability cannot lawfully be excluded.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence or for fraud, or any mandatory consumer or statutory right.
16Grievance Officer and complaints
EFLAG maintains a Grievance Officer for complaints relating to content on the platform, use of the platform, and other matters for which a grievance mechanism is required by applicable law.

Complaints should contain sufficient information to identify the issue, the relevant content or URL where applicable, the basis of the complaint and the complainant's contact details. EFLAG will handle grievances within the timelines prescribed by applicable law, as amended from time to time.
Where applicable law prescribes an expedited mechanism for specified categories of content, including certain privacy, nudity, sexual content or impersonation complaints, EFLAG will follow the applicable statutory timeline.
Nothing in this clause limits any right to approach a competent court, statutory authority, regulator or other lawful grievance mechanism.
17Suspension, termination and account closure
You may stop using the platform at any time and may request closure of your account through the available process.
EFLAG may suspend, restrict or close an account where reasonably necessary because of a breach of these Terms, fraud or abuse, security concerns, unlawful activity, manipulation of platform systems, prolonged inactivity where permitted, or legal or regulatory requirements.
Account closure removes access to the account but does not automatically require deletion of information that EFLAG is permitted or required to retain under the Privacy Policy, applicable law, security requirements, dispute resolution needs or legitimate record-keeping purposes.
The provisions concerning intellectual property, User Content licences already granted, indemnity, disclaimers, limitation of liability, grievance handling, dispute resolution, governing law and any provisions intended by their nature to survive will continue after termination.
18Changes to these Terms
We may amend these Terms from time to time to reflect changes in the platform, law, technology, security, business arrangements or features.
Where a change materially affects your rights or obligations, we will provide notice through the platform and, where reasonably practicable, through an available communication channel. The revised Terms will state their effective date. Your continued use of the platform after the revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law. If you do not agree, you must stop using the affected service.
19Governing law and jurisdiction
These Terms are governed by the laws of India. The courts at Thane, Maharashtra have exclusive jurisdiction, subject to any right you have as a consumer under the Consumer Protection Act, 2019 to bring proceedings where you reside.
